Who we are

Elite Speed Factory (“Elite Speed Factory”, “we,” or “us”) provides a variety of services and features directed to coaches, sport enthusiasts and athletes through our online and mobile fitness offerings.

We are made up of different two different legal entities:

  1. Elite Speed Factory . We provide our services via www.elitespeedfactory.com
  2. Train Heroic, LLC . The TrainHeroic Services are provided through its websites www.trainheroic.com

What personal data we collect and why we collect it

Information You Provide Directly To Us. We may collect the following categories of Personal Data if you provide it to us:

  1. Contact information, which includes name, mailing address, telephone number, e-mail address;
  2. Account registration information, which includes first name and last name, email address, primary sport, gender, username and password;
  3. Profile information, which includes photos, date of birth, weight, geo-location information, activity information, equipment usage, challenge information;
  4. Information regarding your account and subscriptions, such as account type, expiration date; coach information and sponsor information;
  5. Your training plans and programs, goals, workouts, events, recovery, training progress and performances, heart rate, and other training metrics;
  6. Videos you record and provide relating to your workouts and goal performances;
  7. Payment information, such as billing contact information, payment methods, transaction history and payment amounts;
  8. Information you provide to us when inquiring about our products or services;
  9. Any other information you provide to us, including both private messages and user generated, publicly posted content.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

We will also take reasonable steps to ensure you are made aware of any material updates including providing you direct communication about such changes or providing a notification through the services, as appropriate.

If you provide personal information to us or access or use our Sites after this Notice has been changed, you will be deemed to have unconditionally consented and agreed to such changes. The most current version of this Notice will be available on the Sites and Apps and will supersede all previous versions of this Notice.

Who we share your data with

We may share information with third parties in the following instances:

  1. When we are required to do so by law.
  2. In connection with any legal proceedings or prospective legal proceedings.
  3. To establish, exercise, or defend our legal rights, including providing information to others for the purposes of fraud prevention.
  4. When we reasonably believe it is appropriate to apply to a court or other competent authority for disclosure of that Personal Data where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure of that Personal data.

How long we retain your data

We will store your Personal Data for as long as:

  1. You maintain an account with us;
  2. You continue using our Sites and Services;
  3. Your Personal Data is stored in our backup servers and/or services;
  4. As long as we are legally required to retain the Personal Data. Data can be deleted upon request.

What rights you have over your data

You have the right to:

1.            Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

2.           Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

3.            Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

4.           Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

5.            Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

(a)            if you want us to establish the data's accuracy;

(b)           where our use of the data is unlawful but you do not want us to erase it;

(c)           where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or

(d)           you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

6.             Request the transfer of your personal data to you or to a third party. We will provide to you (or a third party you have chosen) your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

7.            Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

8.          You also have the right to ask us not to continue to process your personal data for marketing purposes.

Your contact information

Minimum Age Requirements

Our Services are not directed to children. You’re not allowed to access or use our Services if you’re under the age of 13 (or 16 in Europe). If you register as a user or otherwise use our Services, you represent that you’re at least 13 (or 16 in Europe). You may use our Services only if you can legally form a binding contract with us. In other words, if you’re under 18 years of age (or the legal age of majority where you live), you can only use our Services under the supervision of a parent or legal guardian who agrees to the Agreement.

How we protect your data

When you register for an account with us, you will be required to choose a password which enables you to access our Sites and Services.

You are responsible for keeping this password confidential and for all activity that takes place through your account credentials. Do not share your password with anyone.

If your password is compromised, change your password within your account. If you believe your account may have been compromised,
please notify us immediately.

We take industry standard security measures to protect your information. We also have put into place appropriate agreements and/or procedures with our service providers to ensure that your Personal Data is treated consistent with applicable data privacy and security laws.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your Personal Data, we cannot and do not guarantee the security of your data.

Be aware that if you unsubscribe from our marketing communications we may be unable to notify you of tailored services or offer to meet your needs. If you unsubscribe from marketing communications from us, you will still receive transactional and service messages from us regarding your Events and/or registrations.

We undertake profiling, automated decision making, and analytics to improve our Sites, Apps, and Solutions by providing personalized experiences, location customization, personalized help, and instructions. This means that we may automatically process personal information to evaluate certain personal aspects about you to predict your personal preferences, interests, behavior, or location. Based on our analysis, we then send or display communications or content specifically tailored to your interests and needs.

Some of the purposes for which we engage in profiling, automated decision making and analytics include:

a) to obtain a better understanding of what you would like to see from us and how we can continue to improve our services for you; to personalize the service and offers you receive from us;

b) to provide you with tailored content online and optimize your experience of our Sites;

c) to provide you with tailored advertisements on other websites you visit and social media and digital platforms;

d) to share marketing material we believe may be of interest to you, including from other ACTIVE entities and our third party partners;

e) to help us operate our services more efficiently; and

f) to authenticate log-ins on our Sites and detect and prevent fraud.
